A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant of "2019 Highest 2128" is the representative director of the (State)C located in Ulsan-gu B, Ulsan-gu, who runs the construction business and the wholesale and retail business of building materials using six full-time workers.

When a worker dies or retires, the employer shall pay the wages, compensations, and all other money and valuables within fourteen days after the cause for such payment occurred.

Provided, That the date may be extended by an agreement between the parties in extenuating circumstances.

Nevertheless, the Defendant did not pay the total amount of KRW 32,729,040,040 to two workers within 14 days from the date of retirement without agreement on the extension of the due date between the parties, as shown in the attached Table of Crimes (5 pages), including KRW 27,009,040, which was worked as a business operator of installing light iron bars from March 23, 2015 to August 30, 2018 at the construction site, such as Ulsan-gu D located in Ulsan-gu, the construction site of the said business site.

From December 2008, the Defendant, as the representative of C Co., Ltd., signed a check contract with G Bank Samsandong Branch and the Defendant under the name of G Bank, and traded the check number of shares.

On November 16, 2018, the Defendant issued nine copies of the check number No. 1, 3, 4, 6 through 9, 12, 13, and 14 of the attached Table of Crimes (the sixth pages) and presented nine copies of the check number No. 216,400, 797 per share of the total face value as indicated in attached Table No. 1, 3, 4, 12, 13, and 14 to the C Office located in Ulsan-gu, Ulsan-gu, U.S., for each of the holders of the check at the time of payment, each of the holders of the check presented nine copies of the check number No. 1, 12, 170, 797 within the time limit for payment, but each of them was not paid due to the shortage of deposits.
