A defendant shall be punished by imprisonment for not less than three years and six months.
Reasons
Punishment of the crime
1. On June 14, 2007, in the victim B’s residence located in Seoul Special Metropolitan City, Nowon-gu, 302 Dong 101, the Defendant acquired funds from the victim B, the Defendant: “I want to help her women’s child-friendliness. I want to immediately repay the money to the victim’s father’s property within several days. However, in fact, the defendant was subject to the bankruptcy exemption decision on December 2003, and was employed in the taxi company for business purpose while he was employed in the taxi company, but he was also paid monthly income at a level of one million won, and even if he borrowed money from the victim, such as there was no property inherited within the day, he did not immediately have the intention or ability to pay the money.
As above, the Defendant, by deceiving the victim as above, received the remittance of KRW 100,000 from the victim to the account used by the defendant on the same day, and acquired the total amount of KRW 12,410,000 from that to March 19, 2008 in the same manner as shown in attached Table 1, and acquired the money in total of KRW 1,245,00,000 from September 4, 2007 to March 20, 2008, as listed in attached Table 2, as shown in attached Table 2, by taking 13 times in cash, and acquired the money in total of KRW 2,486,00.
2. On March 2009, the Defendant had operated the Nowon-gu computer store with the trade name “F” from March 2009 to May 2010.
The defendant does not hold a stock of the Nowon-do computer due to the difficulties in the management of the above F Burial, and does not have the ability to procure the Nowon-do computer, and is paid by the clients for the purchase.
