1. The plaintiff's appeal against the defendants is dismissed in entirety.
2. The plaintiff's ancillary claim added at the trial.
Reasons
1. The reasoning of the judgment on the main claim against the Defendants is the same as that of the judgment of the court of first instance, and thus, it is acceptable in accordance with the main sentence of Article 420 of the Civil Procedure Act.
2. Determination of the conjunctive claim against Defendant B
A. The Plaintiff’s assertion that “Defendant B paid KRW 30 million to April 15, 201 under the name of the brokerage commission for the sale and purchase of land located in Kimpo-si, Kimpo-si, but Defendant B, without a licensed real estate agent qualification, was null and void in violation of the former Licensed Real Estate Agents’ Business Affairs and Report of Real Estate Transactions Act (hereinafter “Licensed Real Estate Agents Act”), and Defendant B is liable to pay the Plaintiff KRW 30 million and damages for delay.”
B. The definitions of terms used in this Act before the amendment by Act No. 10580, Apr. 12, 201, of the Business Affairs of Licensed Real Estate Agents and Report of Real Estate Transactions Act, are as follows:
1. The term "mediation" means mediation of sale, exchange, lease, and other gain, loss and transfer of rights between parties to a transaction concerning the objects of brokerage as provided for in Article 3;
2. The term "licensed real estate agent" means any person who has obtained the qualification for licensed real estate agent under this Act;
Article 9 (Registration of Establishment of Brokerage Office) (1) A person who intends to engage in brokerage business shall file a registration of establishment of a brokerage office with the head of a Si (referring to the head of a Si where no Gu is established or the head of an administrative Si of a Special Self-Governing Province; hereinafter the same shall apply)/Gun/Gu (hereinafter referred to as "registration authority") having jurisdiction over an area where he/she intends to establish a
