The prosecutor's appeal is dismissed.

1. The decision of the court below (two years of suspended sentence in February of one year and two years of imprisonment) is deemed to be too unhued and unfair.

2. In full view of the factors revealed in the argument of the instant case, such as the need for a strict punishment in light of the risk, and the accused has the penal power for the same kind of crime, but the above penal power has long been punished by a fine for more than ten years, etc., the sentencing of the lower court cannot be deemed to be unfair because the sentencing of the lower court is too uneasible.

3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act as it is without merit. It is so decided as per Disposition.
