Defendant shall be punished by a fine of KRW 10,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

No one shall introduce, arrange or induce a patient to a medical institution or a medical person for profit, such as exempting or discounting the individual contributions under the National Health Insurance Act or the Medical Care Assistance Act, providing money, goods, etc., or providing transportation to many and unspecified persons, or instigate such act.

The Defendant, from July 201 to December 201, 201, had been in charge of the duties of attracting patients while serving as the chief secretary of the office of the C Council located in Yongsan-gu Seoul Metropolitan Government.

The defendant introduced or mediates patients with mental illness such as alcohol addiction to employees of the National Health Insurance Service or the office of other hospitals, etc., who are private transport enterprises, or provided them with transportation convenience in lieu of the transport charges to be borne by patients or their guardians, the defendant provided them with money and valuables for the introduction of patients and 50,000 won for patients subject to national health insurance, and 40,000 won for patients subject to basic livelihood.

On September 28, 2011, the Defendant: (a) introduced patients under the name of the head of the headquarters at D Hospital E from the above C Council; (b) delivered KRW 400,000 as the consideration for the introduction; (c) transferred patients under the name of the Seoul Emergency Transport Group F from the Seoul Emergency Transport Group F to the above C Council; and (d) transferred patients under the name of the said C Council on July 7, 201; and (c) provided patients with transportation convenience on behalf of the patient with the transportation fee of KRW 150,00,000, in total 77 times in the above method as described in the attached list of crimes (1).
