Punishment of the crime

[criminal history] On April 3, 2015, the Defendant was sentenced to one year of imprisonment with prison labor for a violation of the Narcotics Control Act at the Busan District Court on January 7, 2016, and the execution of the sentence was terminated at the Port Correctional Institution on January 7, 2016. On March 15, 2017, the Defendant was sentenced to one year and two months of imprisonment with prison labor for the same crime at the Busan District Court’s Dong Branch Branch, and the said judgment became final and conclusive on August 24, 2017.

[Criminal facts]

1. On January 4, 2017, at around 22:20, the Defendant: (a) thought that “D” restaurant located in the Busan Eastdong-gu, Busan; and (b) thought that the victim E, the owner of the business, would not open a good door to himself/herself; and (c) found in the main room, the Defendant interfered with the victim’s business by forcing the victim, who was in the main room, to be “h. h. h. h. h. h. h. h. h. h. h. h. h. h. h. to die; and (d) h.h. h. h. h. h. h. h. h. h. for the same year; and (d) on the ground that other customers said to be able to be able to be able, thereby obstructing the victim’s business by force.

2. 공무집행 방해 피고인은 같은 날 22:35 경 같은 장소에서 위와 같은 행위에 대하여 112 신고를 받고 출동한 경사 F를 비롯한 경찰관들이 계속 욕설을 하는 피고인을 말리며 “ 가게 업무에 방해가 되니 나가 서 이야기하자” 고 하자, " 짜 바리 새끼, 내 잡아가라, 똘똘 말아 넣어 라", " 야 이 개새끼야, 씨 발 놈 아", 짜 바리 새끼야 "며 욕설을 하며 위 경사 F를 향해 주먹을 수회 휘둘렀다.

Accordingly, the defendant interfered with the legitimate execution of duties by police officers on the handling of 112 reports.
