1. On the Plaintiff (Counterclaim Defendant),
A. Defendant B&D architectural design, Inc., is KRW 9,808,301 and its related thereto.
Reasons
A principal lawsuit and a counterclaim shall be deemed simultaneously.
1. Basic facts
A. The Plaintiff is a person who operates the CMoel in Daegu-gu, Daegu-gu, and D Kindergartens located in Jung-gu.
B. Around March 2014, the Plaintiff entered into a contract with Defendant B&D Construction Design (hereinafter “Defendant B&D”) for the 444,300,000 construction cost, and thereafter entered into the said contract for the remodeling project with the said B&D construction cost of KRW 566,80,000.
C. On September 24, 2014, the Plaintiff entered into a contract with Defendant Incorporated Co., Ltd. for Carryover Designcom (hereinafter “Defendant”) for the said E-A-A-A-U-U-U-U-U-U-U-U-U-U-U-U-U
Defendant B&D retired from office in the course of performing the said C&T remodeling work, and thereafter, the Plaintiff completed the construction work, and the said E/L repair work and the interior work were completed.
E. On March 23, 2015, the Plaintiff and the Defendant carried forward agreed to set the balance of the construction cost in installments at KRW 125 million with respect to the foregoing EA Kindergarten Art Art., and thereafter, the Plaintiff paid KRW 65 million to the Defendant carried forward.
F. Around April 2015, the Plaintiff and Defendant B&D drafted a written agreement with the Plaintiff on setting the balance of the construction cost and additional tax, etc. to be paid by the Plaintiff to Defendant B&D as KRW 115 million with respect to the said C&D remodeling project and the said E/L repair project.
G. On June 1, 2015, the Plaintiff paid KRW 9.5 million to Defendant B&D, and the Plaintiff paid KRW 7.5 million for the construction cost that Defendant B&D has to pay to F. The Plaintiff paid to G totaling KRW 43.5 million for the construction cost, including the payment of KRW 26.5 million for the household that Defendant B&D should pay to G.
H. The construction cost for repairing defects in the remaining parts of the above E kindergarten E kindergarten E, excluding the sum of flowers leaves, is KRW 117,822,00,00, and the Defendant carried forward additionally.
