The defendant's appeal is dismissed.

1. Reasons for appeal;

A. The defendant was not guilty of assaulting the victim.

B. The punishment of the lower court is heavy.

2. Determination

A. According to the evidence duly admitted and duly admitted by the determination on the assertion of mistake of facts, the fact that the Defendant assaulted the victim on the right side of the victim by breaking the shoulder of the victim, being sealed by the breaking the shoulder of the victim, and breaking the victim’s shoulder by drinking can be sufficiently recognized.
