피고인은 2015. 9. 22. 21:37 경 서산시 읍내동에 있는 ‘ 서령 상가’ 부근 도로에서부터 같은 동에 있는 ‘ 강남 짬뽕’ 앞 도로에 이르기까지 약 300m 의 구간에서 혈 중 알코올 농도 0.198% 의 술에 취한 상태로 B 1 톤 화물차를 운전하였다.
