The judgment below
Examining the evidence duly adopted by the court of first instance, the court below’s determination that each of the facts charged in this case was found guilty on the grounds as set forth in its reasoning is justifiable, and contrary to the allegations in the grounds of appeal, there were no errors by misapprehending the legal principles on “justifiable cause” under Article 15(9)1 of the Establishment of homeland Reserve Forces Act, or by violating the principle of prohibition of double punishment.
Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
