Punishment of the crime

1. On October 15, 2018, the Defendant found one mobile phone worth KRW 400,000,000 in the market value of the victim D lost at the bar near convenience stores located in Gangnam-gu Seoul, Gangnam-gu, Seoul.

The Defendant did not take necessary procedures, such as returning the acquired property to the victim, but did so.

Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.

2. From that day to 13:07 on the same day, the Defendant had the person who was unaware of his name enter the above mobile phone number and authentication number in the same way as shown in the attached list of crimes, and had him settle the total amount of KRW 972,500 by means of a mobile phone small payment method.

As a result, the defendant had a person with poor name obtain economic benefits equivalent to 972,50 won by allowing him to input information without authority in a computer or any other information processing device.
