Reasons
A. A. The Defendant’s general secretary-general and managed the Defendant’s operating fund and its account books; the Defendant was in charge of preparing a statement of financial position and income statement for 2011; the Defendant did not prepare a statement of financial position and income statement for 2012; the Defendant prepared a statement of financial position and income statement for 2013, through a tax accountant; the Defendant did not have a statement of financial position and income statement for 2012, there is no such statement of financial position and income statement for 2012; the Defendant prepared a statement of financial position for 2011, in lieu of a statement of financial position, income statement for 2012 (201), and income statement for 2013; the Defendant’s statement of financial position for 2012 (2011) and income statement for 2013; according to the Defendant’s statement of financial position and income statement for 2012 (5,76,905, 2011) and the said statement of financial position and income statement;
* According to the above facts, according to the total amount of 61,00,000 won in total of 59,823,095 won in total of the assets on the statement of financial position for fiscal year 2012 (201), total amount of 61,00,000 won in total of -1,176,905 won in total and total of 59,823,095 won in total of total of 34,02,619 won in total of the assets on the statement of financial position for fiscal year 2013, total amount of 51,525,000 won in total of -17,52,381 won in total and total of 34,02,619 won in total of the total amount of capital on the statement of financial position for fiscal year 2013, it seems that the defendant could not pay the settlement to the plaintiff
According to the Defendant’s statement of transactions, the Plaintiff carried forward the net profit of KRW 22,045,579, which was deducted from the revenue in 2011 to December 31, 2012. ② The sales revenue of KRW 45,159,065 during the three-month period from October 9, 2012 to December 31, 2012. The net profit of KRW 5,284,863 is generated when reflected in the income statement, and ③ the depreciation cost of KRW 16,371,30 was calculated on the statement of financial position in 2013, and this is not actually paid.
