The appeal is dismissed.

The grounds of appeal are examined.

The lower court rejected the Defendant’s assertion that there was no evidence as to the evidence No. 11 investigation report (related to the results of the analysis of the black cambling cards) and the black cambling cards, and that there was no intention for the Defendant to commit an indecent act against the victim on the grounds as indicated in its reasoning, and found the Defendant guilty on the ground that the facts charged in this case are sufficiently recognized.

In light of the relevant legal principles and evidence, the lower court did not err in its judgment by misapprehending the legal doctrine on the admissibility of evidence and the intention of forced indecent act, contrary to what is alleged in the grounds of appeal.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
