피고인은 2016. 7. 1. 10:30경 서울 중랑구 C아파트 1동 앞에서 피해자 D(여, 26세)의 아파트 베란다 뒤뜰에 피고인이 쓰레기를 버린다는 사실로 피고인과 피해자가 시시비비를 따지던 중, 화가 난다는 이유로 양손을 피해자의 눈 쪽에 들이대며 피해자에게 "눈깔을 파버릴라, 콱~씨"라고 말하는 등 피해자의 신체나 생명에 어떠한 위해를 가할 듯한 태도나 해악을 고지하여 피해자를 협박하였다.
