A defendant shall be punished by imprisonment for a term of one year and two months.

Punishment of the crime

1. Fraud;

A. On July 23, 2009, the Defendant committed the crime against the victim C at the D’s coffee specialty store located in Gangnam-gu Seoul Metropolitan Government, stating that the Defendant would receive and repay the deposit for the F department store Gangnam in Seocho-gu Seoul, Seoul, with the F department store Gangnam-gu, where he/she would lend money to the victim C.

However, in fact, the Defendant had already transferred the operating right to the above Gcop to another person, and did not have any property or income, while the Defendant did not have any loan obligation equivalent to KRW 100 million, so there was no intention or ability to repay the borrowed money even if the Defendant borrowed money from the damaged person.

Nevertheless, the Defendant: (a) by deceiving the victim as above; (b) received KRW 20 million from the victim on the same day as the loan money from the victim; and (c) received KRW 20 million from the above victim on February 11, 2010 for the same reason; and (d) obtained a total of KRW 40 million from the above victim on two occasions; and (b) acquired it by deception.

B. On February 2010, the Defendant made a false statement to the victim H that “If he/she lends KRW 200 million to the victim H, he/she would transfer his/her right to return the lease deposit against the I apartment 14 Dong 207, Yongsan-gu Seoul, to secure the return of the above loan.”

However, the defendant did not have any particular property or income, while he did not have any loan obligation equivalent to KRW 100 million, and there was no intention or ability to repay the loan with the I apartment lease deposit.

Nevertheless, the Defendant: (a) deceiving the victim and deceiving the victim as above; (b) KRW 5 million under the name of the victim on February 9, 2010; (c) KRW 10 million under the same name as around the 22th day of the same month; and (d) KRW 10 million under the same name as around the 26th day of the same month; and (b) the same year;

3.2. It shall be granted each of the KRW 140,000,000 for the same name as that of the border, and KRW 20,000,000 for the same name as that of the same month on the August of the same month.
