A defendant shall be punished by imprisonment for not less than five months.

Punishment of the crime

The defendant operated the "I" construction company in the J.S. H. Sinsan-si H. Sinsan-si University in 1203. The defendant had been urged to return a clan property 160 million won to which the defendant belongs, and the defendant did not have the ability to complete the construction work by entering into a new construction contract with the victim AB even if he did not pay the construction cost. In addition, the defendant did not have the ability to complete the construction work by entering into a new construction contract with the victim AB due to the fact that he did not pay the construction cost, even though he did not pay the construction payment from the owner of another construction site, such as the Y-dong-gu Housing Corporation in the Daegu-gu, Daegu-gu, and the Yan-gu, Youngcheon-gu, Incheon., the defendant paid the construction payment to the subcontractor in the existing construction site.

On March 3, 2010, the Defendant concluded a contract for the construction of electric source housing to be newly constructed on the land located AC at the time of literature with the victim at the above “I” office, and concluded a contract for the construction of electric source housing with the victim by June 30, 2010, and received five million won from the victim’s agricultural bank account on March 8, 2010 as the construction contract deposit.

On May 25, 2010, the Defendant, at the above “I” office, concluded that the Defendant will complete the construction work until August 20, 2010, when partially amending the above contract deposit with the victim and the Defendant would complete the construction work until August 20, 2010. In other words, the Defendant received three copies of cashier’s checks of KRW 10 million from the victim’s seat as the contract deposit, and on the same day, five million won from the Defendant’s national bank account.
