1. The Defendant’s KRW 74,346,00 for the Plaintiff and KRW 5% per annum from November 7, 2013 to July 9, 2014.
Reasons
1. Basic facts
A. On July 1, 2013, the Plaintiff purchased the C farm in Jinju-si and 25 parcels from the Defendant for KRW 870,000,000 (hereinafter “instant sales contract”), and on the same day, paid the Defendant the down payment of KRW 100,000,000 in total, and the intermediate payment of KRW 100,00,000 in total.
B. The main contents of the instant sales contract are as follows.
The seller and the buyer both enter into a comprehensive sales contract for all land and the above-ground buildings, movable property, energy facilities, structures, stables, stables, fixtures, office fixtures, equipment, tools, tools, farming equipment, feed, seedlings, animal, and silver on the land and all kinds of intangible assets on the land within the farm located outside B and 25 lots at the time of Jinju.
