A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

1. In around 2007, the Defendant was aware of the victim E who was found in the above place while setting up a military colon in Incheon Reinforcement-gun, Incheon, and was willing to receive money from the said victim when the Defendant paid money to the Defendant.

Around that time, around November 1, 2007, the Defendant acquired the obligation to create the right to collateral security at KRW 56,000,000 with respect to the “Yecheon-gu F” donated on November 9, 2006, and around November 13, 2006, the maximum debt amount was set at KRW 56,00,000 with respect to the “Yecheon-gu G” donated on November 1, 2006, and around November 3, 2007, the right to collateral security was set at KRW 112,00,000 with respect to the “Yecheon-gu, Incheon-gu, Seoul-do, which was owned by the Defendant,” and there was no intention or ability to repay money from the Defendant without any fixed source of income.

Nevertheless, around July 20, 2007, the Defendant, by deceiving the said victim to the effect that “the Defendant would sell and sell the said victim’s money,” and obtained KRW 9,600,000 from the victim, from that time until March 21, 201, the Defendant received KRW 688,80,000 from the said victim on nine occasions, such as the list of crimes in attached Form D.

2. From October 2010 to October 4, 2010, the Defendant entered into an oral agreement with the Defendant’s house located in Incheon Strengthening-gun, Incheon, with I, and the Victim J, to set up the legal party in Masan located in Incheon Strengthening-gun, to import the patients and divide the proceeds therefrom into the Defendant’s agricultural bank account (K), and transferred KRW 4 million from the victim J to the Defendant’s agricultural bank account (K) on October 4, 2010.

5.A payment of one million won has been made in cash, and 2.1% has been made by I.
