All appeals by the defendant and the prosecutor are dismissed.

Since then there is no significant change in circumstances to consider the sentencing of defendants.

In light of all the circumstances alleged by the Defendant and the Prosecutor, the lower court’s punishment is heavy or unfilled, and thus, is unreasonable, taking into account each petition of appeal, statement of reason for appeal, and other factors indicated in the records of trial submitted by the Defendant and the Prosecutor.

Therefore, in accordance with Article 364(5) of the Criminal Procedure Act, all appeals filed by the defendant and the prosecutor must be dismissed without pleading.
