피고인은 2014. 3. 2.경 불상의 장소에서 스마트폰으로 인터넷 페이스북 사이트에 접속하여, 친구인 B가 위 사이트의 본인 계정에 피해자 C에 대하여 “C 씨발년아 이거보면 처 전화해라. 니가 한말을 어따 나한테 밀어붙이고 자빠졌냐 아가리질은 니가해놓고다니고 엄한사람한테 덮어쒸우고지랄이야 시발년아. 당당하면처나와서 몰래숨어서 내글처보지말고. 니가처안나온다면 내가 시발년아 니년 꼭찾아내서니년이 주둥이질한거밝힐거야”라는 내용으로 게시한 글에 “ㅋㅋㅋㅋㅋ태생부터가 그런앤데 어케ㅠ 나이먹으면 고칠줄았앗더니 더발전하고다니네ㅋㅋㅋㅋㅋㅋㅋㅋㅋㅋ 진짜 자랑인줄알아, 더 진화했어 업그레이드함 나이랑같이 업그레이드하나봐, ㅋㅋㅋㅋ 진짜 찌질하기짝이없어 저지랄할꺼면 왜 너한테 짓거려 ㅋㅋㅋ 진짜 알수가없어, 아니 만나서 짓거리라해 ㅋㅋㅋㅋ 왜 피해저지랄들해노코 ”라는 댓글을 게시하여 공연히 피해자를 모욕하였다.
