Punishment of the crime
Defendant
E is the representative director of the corporation, and the defendant D, the defendant A, the defendant B, the defendant C, and the defendant F are the employees of the corporation N.
Around June 21, 2016, N Co., Ltd. entered into a waste disposal contract with Samsung Electronic Co., Ltd. and the Samsung Electronic Co., Ltd., for a period of one year from July 1, 2016 to June 30, 2017, with a view to completely crushing smartphones discharged from the place of business of Samsung Electronic Co., Ltd. and purchasing them.
1. At around 08:00 on April 21, 2017, Defendants D, A, B, and C: (a) entrusted the disposal of 3,167 smartphones for research and development, and verification, owned by the victim Samsung Electronic Co., Ltd.; (b) while crushinging the aforesaid smartphones, approximately 333 of smartphones separated from smartphones (PBA) were laid down under the back below the cover of the waste covering comments; (c) the unit of the smartphone wastes, the scrap of which was completed, was cut down by pretending that the waste was shipped out, and then the unit of the smartphone wastes, the scrap of which was completed, was cut down.
Accordingly, the Defendants jointly stolen the property owned by the victim Samsung Electronic Co., Ltd.
2. Defendant E, Defendant D, Defendant A, Defendant B, and Defendant C C: (a) reported to Defendant E the fact that they stolen smartphones, such as the preceding paragraph, at the N Office, Inc., Ltd. around the first day of the foregoing paragraph; and (b) Defendant E instructed Defendant D, the team leader of the foregoing company, to continuously remove smartphones in the same manner; and (c) expressed mutual intent that the Defendants will steal smartphones in the same manner as that of the preceding paragraph.
A. Accordingly, Defendant D, Defendant A, Defendant B, and Defendant C in collusion with Defendant E, and around April 26, 2017, around 08:00, at the place of business of Samsung Electronic Co., Ltd., Ltd., the head of Samsung Electronic Co., Ltd., Ltd., which was divided from smartphones in the same manner as that of the preceding paragraph, and approximately 833 wastes.
