C. On February 7, 2015, the Plaintiff filed a claim against the Defendant for a trial to confirm the scope of the right of the instant registered trademark under the Patent Tribunal No. 2015Da638, which sought confirmation that the challenged mark does not fall under the scope of the right of the instant registered trademark.

Accordingly, on January 15, 2016, the Korean Intellectual Property Trial and Appeal Board dismissed the plaintiff's appeal on the ground that the challenged mark falls under the scope of the right of the registered trademark of this case.

확인대상표장의 구성 중 ‘護肝寶’ 부분은 그 사용상품의 품질, 효능, 용도 등을 직접적으로 표시하는 기술적 표장이나 ‘헛개나무 열매 추출 분말을 함유하는 제품’을 지칭하는 보통명칭이 아니어서 식별력이 있으므로 상표법 제51조 제1항 제2호 및 제3호에 해당하지 아니한다.

확인대상표장은 그 구성 중 ‘護肝寶’ 부분에 의하여 ‘호간보’로 약칭될 수 있고, 그러한 경우 이 사건 등록상표와 호칭이 유사하다.
