1. Of the judgment of the court of first instance, the part against the defendant in excess of the amount ordered to be paid below shall be cancelled.

Reasons

1. Facts of recognition;

A. 1) The Plaintiff (Appointed Party and its trade name before the change: gold Safety Management Co., Ltd.; hereinafter “Plaintiff 1”)

2) The safety management system of both Company and Selected Co., Ltd. (hereinafter referred to as “Plaintiff 2”)

(2) The Selection Industrial Development Co., Ltd. (the trade name before the merger and change: hereinafter referred to as “Plaintiff 3”)

(2) On August 6, 2011, Plaintiff 1 leased the floor of the Songpa-gu Seoul building (hereinafter “instant building”) from the Defendant as of 30,000,000, monthly rent of KRW 2,500,000, management fee of KRW 500,000 (each additional tax), and the period of September 1, 2012.

2 On October 27, 2008, the Defendant leased the third floor of the instant building from the Defendant for the period of 30,000,000,000, monthly rent of 2,400,000, management fee of 300,000, and the period of 29 October 2010.

3. On September 26, 2008, the Defendant leased the fourth floor of the instant building from the Defendant for the period of 30,000,000, monthly rent of KRW 2,400,000, management fee of KRW 300,000 (each additional tax is imposed separately), and the period of October 22, 2010.

(4) Each of the above lease agreements has been implicitly renewed after the expiration of its validity.

B. From November 2013, the Plaintiffs and the Defendant agreed to terminate each of the above lease agreements as of December 14, 2013, and determined whether to implement reinstatement and the scope thereof after confirming the method of using a new lessee’s building. 2) The Defendant calculated the rent and management expenses on a daily basis from November 1, 2013 to December 14, 2013 and claimed against the Plaintiffs for KRW 5,212,680 from November 1, 2013 to December 14, 2013.
