A defendant shall be punished by imprisonment for not less than two months.

Punishment of the crime

On October 24, 2013, the defendant was sentenced to six years of imprisonment with prison labor in Seoul High Court due to the violation of the Act on the Aggravated Punishment, etc. of Specific Economic Crimes (Fraud), and the judgment became final and conclusive on January 16, 2014.

On July 201, the Defendant stated to the effect that, in a place where the location cannot be known, the Defendant could obtain profits from the market price by selling it again at the time of misunderstanding the market price when purchasing the Damond. As such, once the Damond was purchased, the Defendant stated to the effect that “the Damond is purchased.”

Accordingly, on August 11, 201, the victim believed the horses of the defendant and purchased 1.050,000,000 won as 24,000,000 won from the “E” bank introduced by the defendant in Jongno-gu Seoul Metropolitan Government D with the defendant.

On August 28, 2011, the Defendant made a false statement to the victim to the effect that “When leaving a multimond to B, if the market price was lower, the Defendant would sell the same to B,” and that the Defendant would make the price.

However, in fact, the defendant did not intend or have the ability to return the price to the victim, even though he did not have any property owned by the owner, such as transferring the house beyond the auction after the failure of the business that he operated at the end of 2010 and transferring the house to the auction, living with the owner of the house.

Ultimately, on August 28, 201, the Defendant, as seen above, was issued a total of KRW 24 million in the market price of the said 1.05 square meters and a single 1.03 square meters, from the vehicle of the victim, who was parked on the G Drip Road located in the Jung-gu Seoul Metropolitan Government F on August 28, 201 by deceiving the victim as above, and was handed down by the victim.
