A defendant shall be punished by imprisonment with prison labor for up to six months.
However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.
Reasons
Punishment of the crime
1. Night theft;
A. On July 2019, the Defendant: (a) around 22:00 on July 22, 2019, went to the residence of the victim C located in Busan Shodong-gu; (b) opened an unlocked gate and entered the front passage part of the second floor of the 2nd floor; and (c) opened 20,000 won in total of the market price of the 20,000 won.
Accordingly, the defendant invadedd the victim's residence at night and stolen the victim's property.
B. On August 2019, the Defendant: (a) around 01:00 on Aug. 8, 2019, went to the residence of the victim C located in Busan Sho-gu, Busan; (b) opened an unlocked gate and entered the front passage of the second floor of the 2nd floor of the 2nd floor; and (c) opened the 20,000 female panty panty in an aggregate amounting to the market price of the 20,000 won.
Accordingly, the defendant invadedd the victim's residence at night and stolen the victim's property.
C. On December 5, 2019, around 19:00 on December 5, 2019, the Defendant: (a) opened an unlocked gate and entered the passage front of the second floor of the 2nd floor of the 2nd floor; and (b) carried 20,000 panty of female panty equivalent to the total market price of the 20,000 won, which was rapidly locked.
Accordingly, the defendant invadedd the victim's residence at night and stolen the victim's property.
2. Around December 12:20, 2019, the Defendant was at the victim C’s residence located in Busan Sho-gu, Busan, the Defendant opened a panty and entered the passage front of the second floor of the 2nd floor, but did not discover a female panty to be stolen.
Accordingly, the defendant invadedd the victim's residence and attempted to steal the victim's property.
