1. The Defendant received KRW 2,933,137,00 from the Plaintiff at the same time, and simultaneously received from the Plaintiff:

Reasons
1. Facts of recognition;
A. The Plaintiff is a housing reconstruction association which obtained authorization from the head of Seodaemun-gu Seoul Metropolitan Government on November 26, 2007 pursuant to the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents (hereinafter “Urban Improvement Act”) for the purpose of removing previous buildings on the ground of 63,389.7 square meters, including each real estate listed in the separate sheet owned by the network B (hereinafter “each land of this case”), and for which the registration of incorporation was completed on December 6, 2007.
B. On May 17, 2007, the Mayor of Seodaemun-gu Seoul Metropolitan Government designated the rearrangement zone as a A-house reconstruction zone. However, on December 26, 2008, the Seoul Metropolitan Government changed the rearrangement zone to the effect that the size of the existing rearrangement zone is 63,46.4 square meters.
C. Meanwhile, the Plaintiff collected a written consent from the head of Seodaemun-gu Seoul Metropolitan Government on November 26, 2007, on the basis of the size of 57,684 square meters designated as the first rearrangement zone from 389 among the 455 landowners, etc. in the rearrangement zone, stating the outline of design of new construction structures, the estimated amount of expenses for removal of buildings, and the estimated amount of new construction costs, etc., and obtained authorization for establishment from the head of Seodaemun-gu Seoul Metropolitan Government.
The Plaintiff, as above, shall again reduce the project area into 63,389.7 square meters after the extension of the rearrangement zone as above, additionally collect from 553 landowners, etc. in the previous project site, 441 of the total number of land owners in the previous project site, a summary of the design of new construction, the estimated amount of expenses for removal of buildings, and the estimated amount of expenses for new construction, etc. (the total floor area is 150,813.43 square meters from 150,813.45 square meters and 187,93.45 square meters from 240,96,650,000 to 288,415,753,00 won from 240,96,650,000 won to 288,415,753,000 won, and additionally write down the proportional ratio on the method of calculating the allotted charges by each person subject to parcelling-out and the estimated selling price by members of each square year on June 29, 2010.
