1. The Defendant caused the termination of the title trust on February 28, 2020 with respect to the construction machinery listed in the separate sheet from the Plaintiff.

1. Indication of claim;

A. On March 26, 2018, the Plaintiff completed the ownership transfer registration for construction machinery listed in the separate sheet (hereinafter “dump truck of this case”) on the ground of title trust with the Defendant. The Defendant is a person who owned the title of the instant dump truck before the ownership transfer registration.

[Defendant (C) is a person registered with the business entity of “E” located in Kimcheon-si D, and the Defendant’s husband operates the said “E” together with the Defendant when the Defendant’s husband actually operates the instant dump truck.

The Defendant initially set up a garage of the instant dump truck and entrusted the Plaintiff with the title of ownership of the instant dump truck for the purpose of facilitating convenience in transporting the aggregate of the Plaintiff Company.

However, since there is no more quantity such as aggregate of the plaintiff company to be transported by the defendant, the above title trust agreement has no reason to continue to maintain it.

C. Although the Plaintiff demanded the Defendant to receive the ownership of the instant dump truck again on the part of the Defendant, the Defendant continues to comply with the demand.

Accordingly, on February 28, 2020, the date on which the copy of the complaint of this case was served on the defendant by the service of the copy of the complaint of this case against the defendant was served on the defendant.

The title trust agreement on dump trucks of this case is terminated, and the procedures for applying for the registration of transfer of ownership are sought.

In addition, the Plaintiff is the owner of the instant dump truck: ① KRW 4,126,960 (=2,289,770 mandatory insurance period: from May 16, 2019 to May 24, 16, 2019: 1,837,190: Mandatory insurance period: From July 24, 200 to July 8, 2020 (24:00 to July 24, 2021) and ② Administrative Fines (2) KRW 417,60 (204,000,000 won (213,60 won) and ③ Local tax (4,656,570, including local tax 112,00 won).
