A defendant shall be punished by imprisonment for a term of one year and two months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Even if the Defendant is not a narcotics handler, he handled the psychotropic drugs Mesopha (one philophone, hereinafter “philophone”) and marijuana as follows:

1. On April 10, 2014, the Defendant purchased approximately 12 grams from D, as shown in attached Table 1, including purchase of 12 grams, after remitting KRW 2,500,000 from the Seoul Southern Terminal located in Seocho-gu Seoul Metropolitan Government to D with the purchase price for phiphones, and then receiving approximately one gram of phiphones delivered using high-speed bus service from D.

2. On April 10, 2014, the Defendant administered philophones in the same way 15 times in total, as shown in the attached Table 2 of the Crimes Daybook, including when he injected 0.03g of philophones into arms by dilutioning 0.03g of philophones within the Defendant’s vehicle parked on the front road of Seocho-gu Seoul Metropolitan Government E-building, and injected them into arms using a disposable injection device.

3. Around February 26, 2015, the Defendant administered philophonephones to F by dilutioning approximately 0.03g of philophones from “HMoel” located in Gangnam-gu Seoul Metropolitan Government G with a single-use injection device to F.m.

4. Around March 7, 2015, the Defendant smoked a smoke by inserting approximately 0.05 g of marijuana in a tobacco pipe at the seat of 303 dong 604, Jindo-si, Gindo-si, Gindo-si, and 604.

5. At around March 14:30, 2015, the Defendant: (a) sealed approximately 0.36 grams, and 0.55 grams in the Kmophone 1003 Kmophone located in Gangnam-gu Seoul, Gangnam-gu, Seoul; (b) stored approximately 1.96g of marijuana in a sugar box; and (c) stored approximately 1.96g in the kitchen inside the kitchen; and (d) stored 2 of a single-use injection machine by dilution the volume of the opmophone into aquatic water.

Accordingly, the defendant possessed philophones and marijuana.
