1. The Defendant (Counterclaim Plaintiff) paid KRW 14,506,608 to the Plaintiff (Counterclaim Defendant) and its related amount from July 14, 2015 to January 12, 2017.

The principal lawsuit and counterclaim shall be judged together.

Basic Facts

A. A. Around May 2014, the Defendant entered into a construction contract (hereinafter “instant construction contract”) with the Plaintiff on the condition that the Defendant would contract the Plaintiff with the construction work of the second floor of the general steel structure neighborhood living facilities on the ground (the first floor office, the second floor house, and the building; hereinafter “instant building”) of the Daejeon Seo-gu Daejeon-gu Daejeon-gu Seoul District Office for the construction work (hereinafter “instant construction work”).

B. The instant construction works may be largely divided into ① Iron Corporation and ② other committees, metal, windows, glass, etc. (hereinafter referred to as “grads, etc.”).

C. As the construction cost of the instant construction project, the Defendant paid to the Plaintiff KRW 1.2 million on July 9, 2014, ② KRW 10 million on July 29, 2014, ③ KRW 20 million on August 9, 2014, ④ KRW 1 million on August 25, 2014, and KRW 51 million on the aggregate.

The defendant carried out the work of attaching a panel on the outer wall of the building of this case after the plaintiff was removed from the construction site of this case (i.e., construction cost of KRW 6,550,000 (2,50,000).

[Ground] Facts without dispute, Gap evidence Nos. 4, Eul evidence Nos. 2, and Eul evidence Nos. 2 and 3, and plaintiff's assertion 1) The plaintiff's assertion of the purport of the whole pleadings as to the construction contract of this case is 92,56,608 won in total including steel aggregate construction cost of 46,541,090 won, and construction cost of 46,515,518 won in the board. The plaintiff completed all of the construction work of this case in August 2014. The defendant paid 51 million won as part of the construction cost, and did not pay the remainder. 2) The remainder of the construction cost to be paid by the defendant pursuant to the construction contract of this case shall be 39,983,138 won in total (49,03,138 won in estimated amount of construction work directly executed by the defendant, such as the board of teams, etc. of 9,050,000 won in terms of expenses for installation and damages for delay.

The Defendant’s assertion 1 that the total construction cost under the instant construction contract is KRW 67 million, and the Plaintiff is only KRW 67 million.
