Defendant shall be punished by imprisonment for not less than three years and six months.

The defendant shall be ordered to complete the sexual assault treatment program for 80 hours.

Punishment of the crime

1. Around July 25, 2016, the Defendant carried a child or juvenile pornography with the victim B or D, as described in attached Table 1(1) through (5), and paragraphs (15) through (34) of the Act on the Protection of Children and Juveniles against Sexual Abuse, on the ground that he/she sent the victim’s exposed pictures during the process of dividing the conversations between the victim B ( female juveniles under the age of 19 years) and C Mesens by using smartphones at the Defendant’s home located in Seongbuk-gu, Seongbuk-gu, Seongbuk-si, and then sent them to the victim and kept them.

2. 아동ㆍ청소년의성보호에관한법률위반(음란물제작ㆍ배포등) 피고인은 2016. 10. 2.경 성남시 수정구에 있는 피고인의 집에서 스마트폰을 이용하여 피해자 E(만 19세 미만의 여자 청소년)와 C 메신저로 대화를 나누던 중, 피해자에게 “바지벗고 티조금올려서 팬티까지나오게 해보자”, “배 올려서 팬티다보이게해!!”, “티올려서 다시행”, “티도벗어보자”, “턱밑까지올려”, “티올려!!!”라고 하는 등 구체적으로 지시를 하여 피해자로 하여금 스스로 노출 사진을 촬영하여 전송하도록 하는 등 이때부터 2018. 5. 18.경까지 별지 범죄일람표1 제6항에서 제14항, 제35항에서 제56항 기재내용과 같이 피해자 E, F, G에 대한 아동ㆍ청소년이용음란물을 제작하였다.

3. Around August 14, 2018, the Defendant violated the Act on the Protection, etc. of Children and Juveniles against Sexual Abuse (production, distribution, etc. of obscene materials), and Act on Promotion, etc. of Utilization of Information and Communications Network Utilization and Communications Network Utilization and Information Protection, Etc. (Distribution, etc. of obscenity) by accessing the Defendant’s home located in Seongbuk-gu, Sungnam-si, to the Internet H account (Domain address I), and posting a photograph of the victim’s G ( female juveniles under the age of 19 years) who is a juvenile produced as described in paragraph (2) by exposing the chest and her sexual organ and posting a photograph taken by him/her from August 3, 2018 to the point of time.
