Reasons
1. The ground for appeal by the plaintiff citing the judgment of the court of first instance is not significantly different from the argument in the court of first instance, and even if the evidence submitted in the court of first instance shows each evidence submitted in this court, the fact-finding and judgment of the court of first instance are justified.
Therefore, the reasoning of the judgment of this court is as follows, except for the addition of the judgment on the contents of the plaintiff's assertion made by this court or that of the plaintiff, and therefore, it is consistent with the reasoning of the judgment of the court of first instance.
2. The part of the appeal shall be referred to as “entry” in the third tier 3 of the judgment of the court of first instance.
3. The plaintiff asserts to the effect that there is no proximate causal relation between the parking of the plaintiff's vehicle and the occurrence of the accident in this case, so the plaintiff does not bear liability for damages caused by the accident in this case.
In light of the following circumstances, the accident point of this case is a parking-prohibited place under Article 32 subparagraph 1 of the Road Traffic Act at the intersection, and the vehicle on the part of the plaintiff, which was illegally parked, seems to be likely to pose a danger or impediment to traffic. In particular, the plaintiff's vehicle was partly showing a concrete structure installed to prevent the plaintiff's vehicle from entering the parked right side, and it seems that the driver of the defendant's vehicle would have been hindered in recognizing the structure of the road. Although the vehicle of this case was installed a street around the point where the plaintiff's illegal parking was installed, it seems that it might have been somewhat difficult for the driver of the defendant's vehicle to identify the plaintiff's vehicle or the structure of the road on the part of the plaintiff's illegally parked or the vehicle of this case.
