The sentence of punishment against the Defendants shall be suspended separately.

Punishment of the crime

Trucking oil cost subsidies are "subsidies to link truck oil taxes" that subsidize all or part of the increase in the oil tax due to the restructuring of energy tax in 2001, which are paid by the competent authority with the motor vehicle tax revenue for driving motor vehicles imposed under the Local Tax Act. In using the oil purchase card, it shall not be done through abnormal distribution channels, such as using illegal mobile oil stations or purchasing illegal oil.

1. Defendant A is a cargo driver.

On October 18, 2012, the Defendant purchased fake petroleum products of KRW 1,630 per 1 liter, which are mobile-type portable vehicles operated by F from Part IV of the Seocho-gu Busan Metropolitan City, with the home-ro vehicle operated by F, and with the same method from September 3, 2012 to February 19, 2013, and paid KRW 285,00 with the oil purchase card, as if he purchased the fake petroleum products of KRW 1,78 per 1 liter, he/she has paid 285,00 with the oil purchase card, and he/she has had the head of the Busan District Office, the competent administrative agency, pay KRW 5,387 to pay the above payment as a credit card company, thereby obtaining pecuniary gains equivalent to the above amount, as stated in the attached Table of Crimes (2).

2. Defendant C is a cargo driver.

On February 18, 2013, the Defendant purchased a fake petroleum product mixed with 1,630 won per 1 liter, which is a mobile-type vehicle operated by F in the fourth head parking lot located in the Seocho-dong in Busan Metropolitan City, with a fuel purchase card of KRW 542,00,00, as if he purchased a fake petroleum product with 1,738 won per 1 liter, and then paid a fuel subsidy for the above settlement to the Busan Dong-gu Office, which is the competent administrative agency, as a credit card company.
