1. The Defendant’s each point of the attached Table 25, 26, 27, 28, and 25, among the land 1,110 square meters in Jinjin-si, is indicated as the Plaintiff.
Reasons
1. Basic facts
A. On July 22, 2015, the Plaintiff purchased from the Republic of Korea the land of 1,110 square meters (hereinafter “instant land”) from the Republic of Korea in Jinjin-si, and completed the registration of ownership transfer in the name of the Plaintiff on July 29, 2015.
나. 피고는 2015. 2.경 이 사건 토지 중 별지 감정도 표시 20, 21, 23, 24, 20의 각 점을 차례로 연결한 선내 ㈀부분 69㎡[이하 ‘㈀ 부분’이라 한다] 지상에 같은 감정도 표시 25, 26, 27, 28, 25의 각 점을 차례로 연결한 선내 ㈄부분 [이하 ‘㈄ 부분’이라 한다] 비닐하우스 53㎡를 설치하고, 같은 감정도 표시 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 1의 각 점을 차례로 연결한 선내 ㈁ 부분 25㎡[이하 ‘㈁ 부분’이라 한다], 같은 감정도 표시 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 11의 각 점을 차례로 연결한 선내 ㈂ 부분 103㎡[이하 ‘㈂ 부분’이라 한다]에 각종 비품을 쌓아두는 등 이를 점유사용하고 있다.

2. Determination
가. 청구원인에 관한 판단 위 인정사실에 의하면, 피고는 특별한 사정이 없는 한 이 사건 토지의 소유자인 원고에게 ㈄부분 비닐하우스를 철거하고, ㈀, ㈁, ㈂ 부분 토지를 인도할 의무가 있다.
B. As to the judgment on the defendant's assertion, the defendant raised the objective value of the land by raising the land of this case, and thus, the defendant asserts that he shall exercise the right of retention based on the right to claim reimbursement of beneficial cost equivalent to the construction cost
According to the statements in Eul evidence Nos. 1, 2, and 3, the defendant was designated as the tourist farm development district of Jin-si E forest of 29,000 square meters in Jin-si around March 31, 1995 and received the completion inspection of the tourist farm development project around January 1, 199, but the above facts alone are alone.
