1. The Defendant (Counterclaim Plaintiff) is the Defendant (Counterclaim Plaintiff) with respect to the real estate stated in the separate sheet to the Plaintiff (Counterclaim Defendant).
Reasons
1. Basic facts
A. The Defendant introduced apartment and studio from the Plaintiff to enter into a sales contract, entered into a sales contract, or purchased the sales right as follows.

)을 공급대금 299,700,000원에 분양받았다. 피고는 2015. 6. 4. 원고에게 이 사건 C 아파트에 대하여 떴다방 중개업자에게 지급할 프리미엄 38,000,000원, 제1차 계약금 10,000,000원, 샤시 대금 1,000,000원, 발코니 확장비 1,000,000원, 총 50,000,000원을 지급하고, 2015. 6. 12. 한신공영에게 제2차 계약금 19,970,000원을 직접 지급하여 합계 69,970,000원을 지급하였다. 2) 피고는 수분양자 D로부터 광주광역시 북구 E 아파트 103동 2201호(이하 ‘이 사건 E 아파트’라 한다)의 분양권을 매수하였다.
On May 8, 2015, the Defendant paid KRW 26,800,000 to the Plaintiff, equivalent to 50% of the premium, down payment, and balcony expansion expenses to be paid to the Plaintiff for the instant apartment.
3) The Defendant: (a) around March 2015, 401 out of the G ground buildings in Gwangju Northern-gu (hereinafter “instant G studio”) from the Plaintiff’s office studio F.
(4) On May 28, 2015, the Defendant purchased the sales right under the name of the Defendant with respect to No. 103-dong 805 (hereinafter “instant J apartment”) from K in the name of the Defendant, and purchased the sales right under the name of the Defendant with respect to No. 103-dong 1505 (hereinafter “instant Type 1 J apartment”) from K in the name of the Defendant’s mother M, and paid KRW 64,000,000 each of the sales amount to KRW 16,00,000.
B. On September 3, 2015, the Defendant did not have formed a premium of KRW 38,000,000 for the instant C apartment in the Gwangju Northern Police Station.
