1. It is confirmed that the Defendant’s dismissal of the Plaintiff on January 20, 2017 against the Plaintiff is null and void.

1. Facts of recognition;

A. The defendant is an incorporated association aimed at improving the physical strength of the people through the dissemination of C and supporting and fostering athletes and their organizations.

At present, “ Incorporated Association B” as the Defendant’s name was changed from “ Incorporated Association D” on May 15, 2017, and “ Incorporated Association D” is an organization incorporated in combination between “Gu Incorporated Association B” and “Gu E Federation” on March 11, 2016.

(2) On August 1, 2009, the Plaintiff joined the Defendant and has been serving as an employee of the Accounting Accounting Division.

B. (1) On January 9, 2017, the Defendant ordered the Plaintiff to remove the Plaintiff from position or standby order pursuant to Article 94(1)3 of the Personnel Regulations on the ground that the Plaintiff failed to comply with the Defendant’s president’s occupational instruction.

(2) On January 20, 2017, the Defendant held a personnel committee and decided to dismiss the Plaintiff pursuant to Articles 64 and 65 of the Personnel Regulations on the grounds of the following grounds, and notified the Plaintiff thereof.

Grounds for Disciplinary Action below

1. Failure to comply with the Chairperson's instructions;

(a) refusing to move from circular assignment - In order to expand experience in the process of circulation of the position of an incorporated association D’s smooth progress of work (prevention of a vacancy in the work in the absence of a person in charge, etc.), and to improve the ability to work, the Chairperson, despite the direction of the circulation of the mutual positions between the accounting officers of the former B and the former E Federation, refused to move from the position;
