A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

1. On March 10, 2014, the Defendant concluded with the victim’s “E” office located in Daegu-gu, Daegu-gu, to execute the 3rd floor extension construction of the rest area at a total of 117 million won, and concluded with the victim to the effect that “the Corporation will start from April 14, 2014, and before that, changed in advance the amount of KRW 46.8 million as the down payment.”

However, even if the defendant received the above money from the victim, he did not have the intention or ability to carry out the extended construction work.

On March 11, 2014, the Defendant, by deceiving the victim, received KRW 46.8 million from the victim to the Agricultural Cooperative Account of F, a borrowed account of the Defendant.

2. The Defendant, as stated in the foregoing paragraph 1, has become aware of the victim’s identity;

A. Around March 14, 2014, the victim made a false statement to the effect that “I would complete payment immediately if I would like to lend one million won as I would like to have his or her husband and wife go to study abroad in Japan due to lack of expenses.”

However, even if the defendant borrowed money from the victim, he did not have the intention or ability to repay it.

The Defendant, by deceiving the victim as such, received KRW 90,00 from the victim as the Defendant’s agricultural bank account on the same day.

B. On the 19th day of the same month, at the Defendant’s office located in Daegu Suwon-gu G, the said victim made a false statement to the effect that “I will repay 15 million won to the Defendant, as there is no place to exchange this bill because there is no place to exchange this bill,” and that “I will lend 15 million won as security by the Saturday.”

However, even if the defendant borrowed money from the victim, he did not have an intention or ability to repay it until the date of the promise.

The Defendant, by deceiving the victim as such, received KRW 15 million from the victim as the Defendant’s loan to the said agricultural bank account on the same day.
