1. The Defendant shall pay to the Plaintiff KRW 26,171,917 and the interest rate of KRW 15% per annum from April 14, 2015 to the day of complete payment.
Reasons
1. Facts of recognition;
A. On October 12, 2014, the Plaintiff was awarded a contract by the Defendant for the construction of the Yellow Land Land Construction Corporation on the ground C in the Gyeongbuk-do, Gyeongbuk-do under the following conditions:
(1) Construction period of 1: Commencement on October 20, 2014; completion on February 28, 2015: 153,00,000 won: 30,000 won for down payment, roof work (Seoul Metropolitan Government, etc.), 70,000 won after construction work, 50,000 won for completion of construction, 30,000 won for additional construction work, 40,000 won for 10,000 won for additional construction work, 50,000 won for additional construction work, 50,000 won for additional construction work, 50,000 won for additional construction work, 50,000 won for additional construction work, 11,970,000 won for aggregate construction work, 205,000 won for additional construction work, 305,000 won for additional construction work, 205,000 won for additional construction work
B. On October 24, 2014, the Plaintiff commenced the instant construction, and completed the foundation-based concrete construction, light-weight frame, board, Busan High School, Busan High School, and roof construction, etc., and the Plaintiff suspended construction around December 27, 2014 when a dispute arises with the Defendant regarding the payment of intermediate payments, window-hosing construction, and whether the industrial accident insurance was covered during the construction of yellow soil walls.
C. Meanwhile, the Defendant paid to the Plaintiff KRW 30 million on October 30, 2014, and paid KRW 50 million out of the intermediate payment on December 29, 2014.
The defendant, around March 25, 2015, concluded a new construction of the instant house with another company and completed the remaining construction work, and obtained approval for use on July 14, 2015.
