A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

1. Fraud;

A. On July 24, 2011, at around 15:00, the Defendant made a false statement to the victim C’s house located in the Gumi-si B building 207, stating that “I will pay back only one month if I lend KRW 10 million to the victim, who will lend the business funds related to the construction works of the Mandole waterway.”

However, the defendant did not have any intention or ability to repay the card price and bonds in arrears that he borrowed from the victim, and even if he borrowed money from the victim, he did not have any intention or ability to do so.

The Defendant received KRW 10 million from the victim to the Agricultural Cooperative (D) account in the name of the Defendant.

나. 피고인은 2011. 8. 6.경 전항과 같은 피해자 C의 집에서 피해자에게 “큰 공사를 땄는데 자재비용으로 2,000만 원이 필요하니 돈을 빌려주면 이전에 빌린 돈 1,000만 원과 같이 3개월만 쓰고 갚아 주겠다”라고 거짓말을 하였다.

However, the fact that the defendant did not receive a large amount of construction, and did not want to use the money for the material cost of the new construction, but did not want to use it for the purpose of paying the material cost in arrears. Even if he borrowed the money from the victim, he did not have any intention or ability to pay it up to three months.

The Defendant received KRW 20 million from the victim to the Agricultural Cooperative Account in the name of the Defendant, such as the preceding paragraph.

2. On January 21, 201, the Defendant in breach of trust: (a) when it was difficult for the Defendant to open a savings mutual-aid account under his/her name due to the fact that the Victim C was bad credit holders; (b) the Defendant permitted the Defendant to open a savings mutual-aid account in the name of the Defendant; and (c) the victim subscribed to two products (deduction number E and F) of the Vietnam Federation of the NAC in the name of the Defendant at the Gangseo-dong branch located in 304-4, 304, Young-si, Young-si, the 300,000,000 won in total, and the total amount of payment was 20,000 won.

In such cases, the defendant who lends the name of the savings mutual aid.
