1. The Plaintiff’s rehabilitation debtor corporation, the legal administrator D of the Defendant Rehabilitation Company C, is the legal administrator D.
Reasons
1. Basic facts
A. G Co., Ltd. (hereinafter “G”) is an executor who implements a new construction project of J apartment (hereinafter “instant apartment”) in Young-gu, Young-gu, G (hereinafter “G”), and C Co., Ltd. (hereinafter “C”) is a new construction project of the instant apartment.
B. On December 7, 2009, G entered into a management-type land trust contract (hereinafter “instant trust contract”) with Defendant B Co., Ltd. (hereinafter “Defendant B”) on the instant apartment site with respect to the construction and sale of the instant apartment.
According to the instant trust agreement, Defendant B, as a trustee, shall perform the duties of receiving and managing sales revenues, and perform the duties of executing them, and with the consent of C and I Co., Ltd., the first beneficiary of the trust proceeds, which is the first beneficiary of the trust proceeds, in relation to the withdrawal of funds.
C. On February 10, 2010, Defendant B concluded a sales contract on the instant apartment with the buyer as a trustee under the instant trust agreement.
On April 6, 2010, the Plaintiff concluded a business agreement with Defendant B, C, and G on the following (hereinafter “instant business agreement”) to lend money equivalent to 1/2 of the down payment out of the sales price of the instant apartment to the buyers who concluded the sales contract for the instant apartment.
Article 3. “B” (G and Defendant B) and “A” (C) on the recovery of claims of “A”. (2) Article 7 of the present Convention on the Work of this case concerning a buyer, while Article 3.2 of the present Convention on the Work of this case provides that “Article 8” shall be deemed to be a clerical error, and Article 7 shall be deemed to be “Article 7.”
(Loss of Benefit of Time) If a buyer delays the repayment of a loan due to the occurrence of a cause for the settlement of time, "B" and "B" shall terminate the sales contract for multi-family housing sold by the buyer and pay it to the buyer.
