A defendant shall be punished by imprisonment for not less than one year and six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On January 15, 2014, the Defendant: (a) requested the victim C (the female 38 years of age) who was a woman of the Republic of Korea who was demanded to take a flat hedging at the front of the Yang subway Station located in Yangsan-si on the same day; (b) was refused by the victim; (c) was allowed to take off the cell phone in his/her hand; and (d) went off his/her car with the victim’s bank and arms after cutting off his/her cell phone; and (d) the Defendant continued to get off his/her car at his/her house; (c) was demanded by the victim to get off his/her car continuously, but he/she was allowed to get the victim to get off his/her car at the same time through the vicinity of Yangsan-si, Yangsan-si, and then let the victim take off his/her car at the distance of 20 kilometers to the front of the road in the middle of the same day in Yangsi-si, Yangsan-si; and (d) made the victim to get off his/her car within three hours.
2. The Defendant, at around 18:00 on the same day, is proceeding with the victim to a passenger car as above.
