1. The Defendant’s KRW 38,000,000, and its interest thereon, shall be 20% per annum from October 31, 2006 to July 11, 2016 to the Plaintiff.

On October 30, 2006, the Defendant agreed to make installment payments (on December 13, 2006,000,000 won, January 2, 2007, and KRW 12,000,000,000) three times in three times, on the one hand, at the interest rate of 38,00,000,000 from the Plaintiff as well as damages for delay at the rate of 20% per annum. However, the Defendant did not comply with the above agreement at all.

[However, the part of the claim for damages for delay that is claimed in excess of the rate of 15% per annum from the day after the copy of the complaint in this case is served in accordance with the provision on statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings (wholly amended by Presidential Decree No. 26553, Sep. 25, 2015) is dismissed]
