The judgment of the court below is reversed.

Defendant shall be punished by a fine of KRW 15 million.

The above fine shall not be paid by the defendant.

1. The main point of the grounds for appeal is that the sentence imposed by the court below on the defendant (eight months of imprisonment) is too unreasonable.

At the fifth trial date of the trial, the defendant withdrawn the misconception of facts and misapprehension of legal principles during the grounds for appeal.

2. An ex officio determination prosecutor: “Violation of the Punishment of Violences, etc. Act (a group, deadly weapon, etc.)” in the name of the crime in the trial of the political party as “special assault”; “Violation of the Punishment of Violences, etc. Act (damage to property, etc., such as group, deadly weapon)” as “damage to special property”; “Article 3(1)1 of the Punishment of Violences, etc. Act; Article 260(1) of the Criminal Act” in the applicable law was amended as “Articles 261 and 260(1) of the Criminal Act; “Article 3(1)1 of the Punishment of Violences, etc. Act; Article 366 of the Criminal Act” was amended as “Article 369(1) and Article 366 of the Criminal Act; and thus, the application for permission cannot be amended as it is by the court below.”

3. The judgment of the court below is reversed in accordance with Article 364 (2) of the Criminal Procedure Act without examining the defendant's improper assertion of sentencing, and the judgment of the court below is reversed, and the following decision is delivered through pleadings.
