The defendant shall be innocent.

1. On March 25, 2010, the Defendant made a false statement to the effect that “The Defendant would give the victim the exclusive right to sell scrap metal and copper scrap metal coming from the pulmonary pressure period to B, which would have an amount of KRW 50 million worth KRW 50 million until April 20, 2010 and KRW 50 million until April 20, 2010.”

However, at the time, the Defendant had been urged to repay 49 million won due to the occurrence of the debt owed to another person, and thus, the Defendant was thought to immediately repay the Defendant’s debt with the money that he received from the victim, so even if he received money from the victim, he did not have the intent or ability to supply the said money and valuables to the victim.

The Defendant, as such, by deceiving the victim, received KRW 50 million in total from the victim on March 25, 2010 and KRW 50 million on March 26, 2010.

2. The Defendant had the intention or ability to supply scrap metal, etc. to D, but at that time, the Defendant asserts that he did not abide by the promise on the wind that is bound by another case, and denies the criminal intent of defraudation.

According to the F’s legal statement, goods sales contract made between the Korea Electric Power Corporation and the Korea Electric Power Corporation (F) and the Korea Electric Power Corporation, goods monopoly supply contract made between the said Foundation and the Defendant, investigation report (report on confirmation of the date of detention of the Defendant), etc., the Defendant paid the F’s contract deposit and balance on the closed tension bid to the G Foundation of the social welfare foundation represented by the said Foundation, and given the Defendant the right to sell the scrap metal, such as copper, to the said Foundation, and deducted the said payment from the investments already paid to the Korea Electric Power Corporation. Accordingly, the Defendant received an investment from H to pay the closed tension amount to the Korea Electric Power Corporation and accordingly received the said Foundation from the Korea Electric Power Corporation around March 20, 2010, and accordingly, the Defendant was the said Foundation.
