피고인은 2016. 9. 21. 01:30경 성남시 분당구 E 앞 도로에서 택시를 기다리면서 길가에 서 있던 피해자 F(가명, 여, 20세)을 발견하고 피해자를 뒷좌석에 승차시킨 뒤 피해자에게 계속 말을 걸면서 음담패설을 하다가 “남자하고 연애하는 거 좋아해요, 별로에요 그냥 연애 아니고, 잠자리”, “내가 오늘 아가씨 연애 가르쳐 줄까 ”라고 말하고 인적이 드문 길가에 위 택시를 세운 뒤 뒤를 돌아보면서 피해자에게 “나는 씨가 없어. 다 잘랐어. 아가씨 전혀 부담을 안 가져도 돼, 그렇기 때문에 내가 아무 상관없이 그러는 거야”라고 말하고 피해자의 손을 잡아 피고인 쪽으로 끌어당기고 피해자에게 얼굴을 들이대면서 “나랑 뽀뽀 한 번 해”라고 말하고, 이에 피해자가 손을 빼면서 “아니오, 아니오”라고 거절하자, 다시 위 택시를 출발시켜 목적지로 운행하면서 “내가 아가씨같이 가슴 큰 아가씨를 좋아해, 아가씨 젖꼭지 이만 할 거야”라고 말하는 등 계속하여 음담패설을 하여 결국 피해자가 도중에 하차하기 위하여 위 택시를 세워 달라고 하였고, 이에 피고인은 같은 날 01:52경 의왕시 G 앞 도로에서 위 택시를 정차시킨 뒤 피해자가 결제를 위하여 가방에서 카드를 찾는 사이에 “진짜 가슴 크다”라고 말하면서 갑자기 오른손을 뻗어 피해자의 왼쪽 가슴을 꼬집듯 만졌다.
