1. The Defendant’s KRW 29,700,000 for the Plaintiff and the following: 6% per annum from July 16, 2016 to February 14, 2018.

1. Facts of recognition;

A. The Plaintiff is a person engaged in construction business under the trade name of “B,” and the Defendant is a company engaged in waste collection and transportation business, etc.

B. On July 15, 2015, the Plaintiff entered into a construction contract (hereinafter “instant construction contract”) with the Defendant that the Plaintiff was awarded a contract for construction work of a ground factory with the Defendant for the construction cost of KRW 377,300,000 (including value-added tax) for the construction work of a ground factory with the Defendant in Sungsung City C (hereinafter “instant land”).

C. The contents of the instant construction contract include the package work at 600 square meters among the instant land, and the relevant construction cost was KRW 47,655,000 (including KRW 44,125,000 general management cost and KRW 3% of profits and KRW 5% of general management cost).

After the defendant's request, the package work was added to the part where approximately 100 square meters and the boundary was installed, and the actual area of the packing work performed by the plaintiff is about 940 square meters (3109 square meters).

2. The assertion and judgment

가. 당사자들의 주장 ⑴ 원고의 주장 ㈎ 포장공사의 면적이 추가되었고, 원고가 실제로 투입된 자재를 기준으로 계산한 추가 공사대금은 33,399,372원(부가가치세 포함)이다.

㈏ 원고는 이 사건 공사계약과 별도로 폐기물을 처리하였고, 폐기물 처리비용 3,740,000원(부가가치세 포함)이 발생하였다.

㈐ 따라서 피고는 원고에게 추가 공사대금 등 합계 37,139,372원 및 이에 대한 지연손해금을 지급하여야 한다.

⑵ 피고의 주장 ㈎ 이 사건 공사계약 당시 포장공사의 면적을 정확히 특정할 수 없어 면적을 600평으로 기재하였을 뿐이고, 공사대상 토지 중 건물이 신축되는 부분을 제외한 토지 전체에 대하여 포장공사를 하기로 하고 이에 대하여 공사대금을...
