Punishment of the crime
Defendant
A is a person who has overall control over the affairs related to local subsidies granted from three cities as the secretary general of C in three times.
1. On August 19, 2015, the Defendant related to the 4rd D Games subsidies was supplied with 6,730,000 won in the office of the said federation on August 19, 2015, and the Defendant was actually supplied with 6,730,000 won in the form of 10,80,000 won in the form of a false quotation to the F and had the F officer pay 10,80,000 won in the form of the “E” as if he was supplied with the goods equivalent to 10,80,000 won in the form of a false quotation to the F, and was returned from August 24, 2015, 3,090,800 won after deducting value-added tax from the difference to the G account (HI) in the name of the financial director of the said federation.
As a result, the Defendant, by deceiving F, obtained 10,80,000 won of the subsidy owned by the victim Sam-si from F, and by deceiving 3,090,800 won, which is the difference between the value of the goods and the value-added tax, and received the subsidy by means of false application.
2. On October 27, 2015, the Defendant related to the subsidies of the J Games submitted a false quotation to the F to pay KRW 2,610,000 to the E, as if he/she was supplied with the goods equivalent to KRW 880,00,000 from the E, even though he/she was actually supplied with the goods equivalent to KRW 2,610,00,000 from the E, and then returned KRW 1,50,050,050, which was deducted from value-added tax from the difference from the “E” on November 4, 2015 to the said G account in the name of the said G.
As a result, the Defendant, by deceiving F, obtained a subsidy of KRW 2,610,00 from F, which is owned by the injured party, and obtained from F, 1,50,050, which is the difference between the value of the goods and the value-added tax, and received a subsidy by fraudulent application.
3. Subsidies for the 5rd D Games, 2016;
A. The Defendant, who violated the Local Finance Act, grants subsidies from the office of the foregoing federation on August 4, 2016 and from the third party.
