A A shall be punished by a fine of KRW 3 million and by a fine of KRW 2 million.

The above fine is imposed against the Defendants.

Defendant

A is a person who operates a mutual cultural heritage trade business entity referred to as "D" in Gyeyang-gun C.

Defendant

B is a person who operates a mutual cultural heritage trade business entity called “F” in Gyeyang-gun E.

1. A person who intends to engage in a business of trading or exchanging tangible cultural heritage or tangible folklore resources (including any person who engages in such business on commission) belonging to Defendant A shall obtain permission for cultural heritage trade business from the Governor of a Special Self-Governing Province or the head of a Si/Gun/Gu, as prescribed by Presidential Decree;

In addition, a cultural heritage trader shall keep account books on trading, exchange, etc., as prescribed by Ordinance of the Ministry of Culture, Sports and Tourism, and shall record the details of the transaction, and shall photograph and attach the photographs of actual objects so that it can be verified.

Nevertheless, the Defendant is an individual warden and a family member in a trade of cultural heritage trading company called “D” located in Gyeonggi-gu Group C.

In order to sell and purchase cultural heritage in a way of awarding a successful bid to a purchaser who finds the cultural heritage that has been secured directly by the selling company and the cultural heritage that has been requested by the selling company.

The Defendant, at around September 18, 2014, sold to a male, whose name cannot be known in the foregoing “D”, one earth disease of the Joseon Dynasty, a cultural property, in cash, KRW 80,00, as well as operated “D” in Yangyang-gun G for about one year from April 8, 2012.

After that, on January 26, 2015, the "D" was transferred to Gyeyang-gun C and operated cultural heritage trade business without obtaining permission from the head of Gyeyang-gu Gun.

2. A person who intends to engage in the business of trading or exchanging tangible cultural heritage or tangible folklore resources belonging to Defendant B (including any person who engages in such business on commission) shall be the Governor of a Special Self-Governing Province or the head of a Si/Gun/Gu, as prescribed by Presidential Decree.
