1. The Defendant (Counterclaim Plaintiff) is a calcium or salt in the Seoul Myeong-si Park where the Plaintiff (Counterclaim Defendant) is located in the Seoul Myeong-si.

1. Basic facts

A. The fire service complex was created in the Sincheon-si and the Sincheon-dong Department, which had cultivated flowers and pots, etc., and the Defendants operated the pots of powder (Defendant A, B, C, D, E, F, hereinafter “Defendant A”) and the pots of flowers (Defendant G, H, I, J, K, K, L, and hereinafter “the Defendants”) for a long period.

B. The Plaintiff operated the Seoul Gyeongnam Park in the vicinity of the said flower Park, and spread large quantities of salt on the racing paths of the said Gyeongnam Park in order to prevent the iceing of sand by the racing on each winter iron, thereby promoting the safety of the racing, the horse, and the horse.

C. The Defendants’ farm members were located at a place less than 220 to 420 meters away from Seoul Myeong Park. Since 2008, they were damaged due to death of cultivated crops. The Defendants, which became aware of the Plaintiff’s salt spraying, filed an application for environmental dispute mediation with the Central Environmental Dispute Mediation Committee (hereinafter “Central Environmental Committee”) against the Plaintiff as the respondent with respect to the damage to destroyed powder goods cultivated by them.

The central environmental level of Apr. 12, 2013, following the process of fact-finding and expert opinion review, with respect to the Defendants’ application on Apr. 12, 2013, ① the Plaintiff used in large quantity (231~361 ton) each year after the opening of the Seoul Morse Park, ② the concentration of salt ion in groundwater used by the Defendants for the purpose of water use exceeds the agricultural water quality standards with 246-427mg/liter, the concentration of salt ion in groundwater in the race track exceeds 341-345m/liter, and the concentration of salt ion in M, which is located in the route that flows from the race track to the agricultural source of the Defendants from the race track, is also higher than 120-1,400m/liter, ③ the soil and underground water survey conducted by the Environmental Management Corporation in 208, thereby cultivating pollutants from the racing.
