Examining the evidence duly admitted by the first instance court, which maintained the reasoning, the lower court was justifiable to have determined that the instant facts charged was recognized on the grounds stated in its reasoning.

In doing so, there is no violation of the law of logic and experience and the principle of free evaluation of evidence, or there is no error of law by misunderstanding the legal principles on embezzlement.

Therefore, by the assent of all participating Justices, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices.
