The judgment below

The remainder, excluding the dismissed part, shall be reversed.

The defendant shall be punished by imprisonment for not less than eight months and a fine.

1. The lower court dismissed the public prosecution regarding the insult of the victim B among the facts charged in the instant case and convicted the remainder of the facts charged.

However, only the defendant appealed against the guilty portion of the judgment of the court below, and the dismissed part of the judgment of the court below was separated and finalized.

Therefore, the scope of this court's judgment is limited to the conviction part of the judgment below.

2. Summary of the grounds for appeal (the factual error and inappropriate sentencing)

A. Since the defendant's report of mistake of facts (2017Kadan5406 of the original judgment) is consistent with all the facts, the judgment of the court below which found him guilty of this part of the facts charged is erroneous in the misapprehension of facts and thereby adversely affected the conclusion

B. Unreasonable sentencing (other than dismissal of prosecution in the original judgment) is too unreasonable that the sentence imposed by the lower court (limited to 8 months of imprisonment and 1.50,000 won) is too unreasonable.

3. Judgment on the Defendant’s assertion of misunderstanding of facts (No. 2017Sang5406)

A. The Defendant asserts to the effect that, since the building operated by K restaurant was an unauthorized building, the above restaurant was operated without permission, the above restaurant was operated without permission.

원심 및 당심이 적법하게 채택하여 조사한 증거들에 의하여 인정되는 다음과 같은 사실 및 사정 즉, ① 이 사건 신고 당시 K 음식점은 서울 구로구 V 소재 건물을 영업장소로 하여 영업신고를 받은 상태였는데, 2018. 7. 9. 위 건물 중 14㎡ 판넬샤시 부분이 무허가건물로 밝혀져 이후 건축물대장에 위반건축물로 등재된 점, ② 이에 따라 위 음식점 운영자 R는 2018. 9. 3. 구로구보건소에 ‘위법건축물’임을 이유로 자진폐업신고를 하였던 점, ③ 피고인은 2018. 9. 7.
